All 5th Judicial District Attorney offices remain operational, but are restricted to the general public in an effort to prevent COVID -19 transmission.  As a precaution, those entering an office are required to submit to temperature checks, an inquiry regarding COVID-19 symptoms, and masking requirements.  Anyone who does not meet these requirements will be refused entry to a District Attorney Office.

Eagle, Colo. (Eagle County) – Robert Fergus-Jean, 38, of Vail, was found guilty yesterday by a jury of: Illegal Discharge of a Firearm (F5); Criminal Mischief (M1); Prohibited Use of Weapon (Aiming a Firearm) M2; Prohibited Use of a Weapon—Drunk w/Gun (M2); and, Reckless Endangerment (M2). On Dec. 30, 2020, Vail Police Officers were dispatched to a domestic disturbance involving Defendant Fergus-Jean and his roommate, Stephen Darley, at the Lion’s Ridge Apartment Homes. When police arrived, both men were leaving the apartment unit calmly, but Darley had blood on both of his legs, including a bloody gauze falling off his right ankle. When Fergus-Jean was questioned about what happened, he said, “…Yeah..so well…he was shot..” As medical support was called for Mr. Darley, both men were questioned about the night’s events. Per investigation and reports, the men had been drinking alcohol and eating psychedelic mushrooms, listening to music—when Darley became upset because the music was turned down. After the argument, Darley went back to his bedroom and Fergus-Jean followed. Per Fergus-Jean’s account, Darley pulled a .38 caliber revolver from his nightstand and pointed it at him. Fergus-Jean then ran to his room and pulled out his .45 caliber semi-automatic handgun. Fergus-Jean claimed he was concerned about Darley shooting him while drunk and consuming mushrooms, so he shot six times through Darley’s closed bedroom door, hitting him twice in his legs (one in the right leg, one in the left). Mr. Darley has since recovered from his wounds. One of the bullets Fergus-Jean shot went through Darley’s bedroom wall and into his neighbor’s adjoining room---narrowly missing the neighbor while he slept. “Drinking and consuming dangerous drugs will never lead to anything good happening,” said District Attorney Heidi McCollum. “And, when people match that behavior with loaded firearms, they mix a dangerous cocktail that can always be deadly,” McCollum added. Fergus-Jean will be sentenced on May 11, 2022, at 1:30pm. -DA5-

Man Sentenced 8 Years to Life in Prison for Child Sexual Assault Georgetown, Colo. (Clear Creek County) – Bobby Lee Fox, 73, of Aurora, was sentenced Feb. 14, 2022, to eight years to life in the Colorado Department of Corrections (DoC) for Child Sexual Assault and Abuse of a then 14-year old teenager at a cabin near Idaho Springs in the summer of 2018. Despite pleading not guilty, on Oct. 12, 2021 a Clear Creek County Jury found Fox guilty on all charges: Count 1--Sexual Assault on a Child (By a Person in a Position of Trust) Under the Age of 15 (F3); Count 2--Sexual Assault on a Child (F4); and, Count 3--Child Abuse (M2)—Knowingly/Reckless—no Injury. Fox was sentenced to eight years to life (with mandatory 5 years parole) on Count 1, and six years (concurrently) on Count 2 (with 3 years parole). Per law enforcement investigations, the teenage boy’s mother contacted the Clear Creek County Sheriff’s Office (CCSO) to report that her 14-year old son was with a family friend (Fox) at a cabin and had texted her he was in distress because of Fox. After working at the cabin for two days, the teenager told Fox his back hurt, and Fox offered to rub it and put some lotion on it. The teen fell asleep during the massage and woke up, needing to go to the bathroom where he noticed lotion on his genitals and other areas. Forensic tests from a Colorado Bureau of Investigation lab report confirmed Fox’s DNA was present in the underwear of the teenager. “While there is no way we can truly bring justice to the victim and his family in this case, we hope that some semblance of healing can now begin with the defendant’s sentence to a lengthy prison stay in the DoC,” said Heidi McCollum, 5 th Judicial District Attorney. “While there may be more Bobby Fox victims out there, my hope is you will come forward to law enforcement so we can ensure this man never hurts another child again,” she added. -DA5-
